Rath Young and Pignatelli’s Insolvency, Bankruptcy and Financial Restructuring Group deploys its skills and experience to negotiate, litigate, and provide transactional advice to meet our clients’ needs and objectives in distressed commercial situations. Our attorneys represent a multitude of parties in insolvency-related litigation, including debtors, creditors, creditors’ committees, estate fiduciaries, and investors in a variety of situations and venues, including bankruptcy courts, insolvency proceedings before state courts and administrative agencies, and out-of-court workouts. We represent clients in state and federal courts in New England and around the country. Our clients operate across a wide range of sectors, including real estate, hospitality, healthcare, insurance, telecommunications, and manufacturing. We have been retained to serve in fiduciary roles and to represent fiduciaries and trustees in bankruptcy cases and in proceedings involving the liquidation of insolvent insurance companies. This experienced team is supplemented by the resources and expertise of our full-service law firm to address the unique challenges, pressures, and risks that arise when clients find themselves in financial distress or impacted by the financial troubles of others.

Members of this group and our broader business litigation team have substantial trial experience and have represented clients in a broad array of insolvency-related contested matters, including plan confirmations, relief from stay proceedings, claims objections, valuation disputes, and DIP financing hearings. We have also successfully prosecuted and defended actions seeking to avoid and recover preferential and fraudulent transfers and have counterparties to contracts which debtors seek to reject or assume and assign in bankruptcy cases.
