We help employers comply with the constantly changing federal and state laws that govern the workplace by reviewing and updating employment handbooks and ensuring that policies and procedures take into consideration the laws and needs of particular industries.
- Assist clients on wage and hour, leave and termination issues and health insurance matters including compliance with state and federal laws, such as the ADA, PPACA, FMLA, and FLSA.
- Draft and update employee handbooks policies and procedures to ensure compliance with current and changing law.
- Train managers, administrators, school faculty, employees, and students on how to prevent unlawful harassment, hazing, and bullying.
- Conduct effective workplace investigations and training regarding sexual harassment, managing diversity, and Title IX compliance.
We provide proactive guidance to our clients to help them avoid compliance failures in the first instance. However, when disputes do arise, we represent our clients before state and federal administrative agencies, including the EEOC, the New Hampshire Commission on Human Rights, the Department of Labor, and in litigation before state and federal courts.
- Represented companies and executives in disputes and litigation regarding executive employment contracts and professional services agreements in state and federal courts.
- Defended businesses in wage and hour, time card, payroll tax, and other matters before and against the Departments of Labor, Departments of Revenue, and EEOC.
- Successfully and efficiently litigated wrongful termination and discrimination claims for small, medium, and large employers.
We regularly represent employers in the negotiation of complex executive compensation agreements. In addition, with the assistance of our corporate and insurance teams, we are able to offer employers guidance related to employee benefit plans, as well as the development and implementation of equity incentive compensation plans.
- Draft and review executive compensation and other employment and personal service agreements.
- Develop equity incentive compensation plans, including for early stage businesses.
- Provide guidance regarding the application of ERISA, the Patient Protection and Affordable Care Act, and other federal and state laws governing employee benefit plans.
- Assist professional services firms with the development and implementation of employment and compensation arrangements, including deferred compensation plans.
