Rose Marie Joly is a member of the firm's litigation and health care practices.  Rose focuses her practice on medical malpractice defense in cases brought in state and federal court, as well as disciplinary matters brought before the New Hampshire Board of Medicine.  Her practice includes defense of hospitals, doctors, physician's assistants, nurses, midwives, nursing homes and assisted living facilities.  Rose also does work in the areas of personal injury and commercial disputes, and has defended employment lawsuits.

Prior to joining the firm in 1999, Rose practiced law from 1996 to 1999 with the Concord law firm of Gallagher, Callahan & Gartrell, where she was a member of the civil litigation practice, working on matters in both state and federal court.  From 1995 to 1996 Rose was the Senior Law Clerk for the New Hampshire Superior Court, and a law clerk for the court from 1994 to 1996.  In this capacity, she assisted the justices of the court in all counties with both civil and criminal matters.

Representative Matters
  • Successfully defended medical negligence cases before the New Hampshire Supreme Court in which the lower Court had granted summary judgment on statute of limitations grounds.
  • Served as second chair in the New Hampshire Superior Court trial of a physician alleged to have committed medical negligence in failing to diagnose breast cancer.
  • Represented physicians in Superior Court cases alleged to have committed medical negligence in a number of practice areas including but not limited to obstetrics, gynecology, pediatrics, oncology, and radiology.
  • Represented several nursing homes and assisted living facilities in defending claims brought before the New Hampshire Superior Court of negligence relating to patient/resident injuries.
  • Successfully represented a physician before the New Hampshire Board of Medicine charged with self-prescribing controlled substances.
  • Assisted in successfully representing a physician before the New Hampshire Board of Medicine charged with gross and repeated negligence in the treatment of one patient where the physician had a working diagnosis that ultimately proved erroneous.
