Rath, Young and Pignatelli Litigators Win Medical Malpractice VerdictDecember 2007Nashua, New Hampshire Michael Pignatelli and Ken Bartholomew, members of the Rath, Young and Pignatelli Litigation Practice Group, won a defense verdict in a medical malpractice case in December 2007 for a Nashua, New Hampshire doctor after an eight-day jury trial. The case, tried against plaintiffs’ law firm Crowe & Mulvey out of Boston, was one of the first cases to reach a verdict after being reviewed under New Hampshire’s new medical malpractice screening panel law. The case involved an allegation that a Nashua neurologist’s failure to timely diagnose a stroke after cardiac catheterization led to the patient’s complete disability. The jury agreed with the defendant’s expert neurologist and neurosurgeon that an earlier diagnosis, before the onset of any focal signs of stroke, would not have resulted in a better outcome. |
