Rath, Young and Pignatelli Litigators Win Medical Malpractice Jury Trials

March 2010

Attorney Michael Pignatelli won a defense verdict in a medical malpractice trial in a complicated, multi-party case brought in Hillsborough County Superior Court.  The allegations were that our client, a well-respected physician, failed to diagnose tuberculosis meningitis during a four day hospital stay in Nashua.  The lawsuit claimed the doctor's actions led to a poorer outcome due to delayed institution of anti-tubercular medications.  We mounted a vigorous and winning defense that our client complied with all applicable standards of care and could not have saved this very ill patient.  "We'd like to believe doctors can save every patient who arrives at the hospital," say Pignatelli.  "But we have to be reasonable in our expectations of even the most talented and well-trained physicians."  The jury deliberated for two days before finding for our client.

Novemver 2009

Michael Pignatelli and Rose Marie Joly, members of the Rath, Young and Pignatelli Litigation Practice Group, won a verdict in a medical malpractice trial for a Wolfeboro, New Hampshire doctor.  The five-day trial was heard in Carroll County Superior Court.  The allegations were that our client failed to perform a cardiac stress test and this failure led to the death of the plaintiff due to undiagnosed heart disease.  Through strong cross-examination of witnesses, we prevailed by eliciting favorable testimony from an opposing expert witness that was backed up by our own experts.  Following seven hours of deliberation, the jury returned its verdict in favor of the doctor.
